Leasing Guidelines
To assist you in your lease negotiations with us when considering entering into a permanent lease with us for a shop, we have provided links to some excellent government documents.
As with any guidelines, they are designed to help you ask the right questions and further your understanding. These guidelines / booklets cannot replace professional advice but they can help you focus on what advice you will need.
These guidelines and booklets give you warnings and checklists to help you decide how and when to ask for expert help when considering a retail lease. You should get advice from a solicitor, preferably one who has expertise in retail leasing. Other sources of help and information are your local retail tenancy office, small or retail business association, or the Office of Fair Trading.

Note: This booklet is currently being reviewed by the Department of Innovation, Industry, Science and Research. Elements of the information in the publication may be out of date. Please use the information with caution.
This booklet is designed for people thinking about signing a new lease for a business location. It can help you answer general questions about retail leasing all over Australia, but remember there are some specific differences among the States and Territories.
The purpose of the booklet is to help you avoid mistakes that others have made. If you know what questions to ask before signing a lease, and where to look for more information, you might avoid expensive misunderstandings that could cost you your business.
Retail Tenancy Unit
The Retail Tenancy Unit, part of the New South Wales Government Department of State and Regional Development, has some excellent information to assist retailers entering into a lease.
Click to view their "Info Kit for Retail Tenants" which has been developed to help you better understand your leasing arrangements and the coverage currently provided by The Retail Leases Act 1994 (NSW).
NSW Retail Tenant's Guide
Click to download a copy of "The NSW Retail Tenant's Guide" which must be given to you, with a copy of the proposed lease, at the commencement of lease negotiations.
